Prosecution waiting for medical records in bank robbery case

Before they can reach a settlement with a man known as the "No Face Bandit," prosecutors are waiting to receive the medical records of an inmate he allegedly beat while in jail.

Peter Klein, 50, of Aromas, stands accused of 11 federal counts of armed bank robbery and 27 felony counts of false imprisonment, robbery and possession of stolen property brought against him by the Santa Clara County District Attorney's Office. His charges stem from a year-long spree of robberies in Santa Clara, Santa Cruz and Monterey counties - including four Gilroy banks - according to prosecutors.

Klein's charges in Santa Clara County carry a maximum prison sentence of 27 years and four months, according to prosecutors.

Prosecutors were close to reaching a settlement with the defendant when he assaulted another inmate in custody, Deputy District Attorney Cindy Hendrickson said. Her office added a count of battery causing serious bodily injury to his charges, staining what had been an otherwise clean record before the robbery charges and complicating the original settlement, Hendrickson said.

Hendrickson subpoenaed the victim's medical records to verify the extent of his injuries.

"We need to get the actual medical records before we can say 100 percent," Hendrickson said. "That's the hang-up because we want to resolve all these cases together."

Klein's case was continued to Dec. 28 in the South County Courthouse in Morgan Hill. Hendrickson said she hopes to resolve the assault case at that hearing, after which prosecutors can settle the federal and state charges stemming from the bank robberies.
