DA says gun case ‘pending’ after boxer claimed it’s ‘taken care of’

A Queens County District Attorney spokesperson responded to Gilroy boxer Robert Guerrero’s claim – that gun charges stemming from his March 28 arrest at a New York airport are “taken care of” – by saying his comment “doesn’t change the case.”

“He can say whatever he wants, but it doesn’t change the case,” the spokesperson said Thursday. “The case is still pending. The case is still on.”

Guerrero is scheduled to appear in court May 14 – 10 days after Saturday’s bout with Floyd Mayweather Jr. at the MGM Grand Garden Arena in Las Vegas. Guerrero faces a four-count criminal complaint, which alleged one count of criminal possession of a firearm and three counts of third-degree criminal possession of a weapon, according to the Queens County District Attorney’s office.

He was arrested at New York’s John F. Kennedy International Airport and charged on suspicion of illegally traveling with an unloaded Smith & Wesson .40-caliber gun – which is registered in California – and three unloaded high-capacity bullet magazines.

If convicted of all charges, Guerrero could face up to seven years in prison.

On Tuesday, Guerrero told ESPN the incident was a misunderstanding.

“It’s all taken care of,” Guerrero told ESPN. “It was a misunderstanding. (Showtime) wanted to film me doing a thing here in Las Vegas. I’m an active fisherman, hunter. Unfortunately, they didn’t make it here. I was just unaware of New York City law.”

According to ESPN, Guerrero’s co-manager, Luis DeCubas Jr., declined to answer questions about the gun charges. Neither DeCubas nor publicist Mario Serrano immediately returned respective phone calls Thursday.

The DA spokesperson made the statement about Guerrero’s remark when asked whether there is an update to the case such as a plea bargain or lesser charges.
